Article L1126-15 of the French Public Health Code

Before a performance study is carried out, information is given to the person taking part by the investigator or by a doctor representing him. Where the investigator is a qualified person, this information is provided by that person or by another qualified person representing him. The information shall be communicated in accordance with paragraphs 2 to 6 of Article 59 of Regulation (EU) 2017/746 of the European Parliament and of the Council of 5 April 2017.

Where the performance study concerns the field of maieutics, the investigator may entrust a midwife or a doctor with the task of communicating to the person who lends himself to this performance study the aforementioned information and obtaining his consent.

When the performance study concerns the field of dentistry, the investigator may entrust a dental surgeon or a doctor with the task of communicating the aforementioned information to the person undergoing this performance study and obtaining his/her consent.

Préalablement à la réalisation d’une étude des performances, une information est délivrée à la personne qui y participe par l’investigateur ou par un médecin qui le représente. Lorsque l’investigateur est une personne qualifiée, cette information est délivrée par celle-ci ou par une autre personne qualifiée qui la représente. L’information est communiquée conformément aux paragraphes 2 à 6 de l’article 59 du règlement (UE) 2017/746 du Parlement européen et du Conseil du 5 avril 2017.

Lorsque l’étude des performances concerne le domaine de la maïeutique, l’investigateur peut confier à une sage-femme ou à un médecin le soin de communiquer à la personne qui se prête à cette étude des performances les informations susvisées et de recueillir son consentement.

Lorsque l’étude des performances concerne le domaine de l’odontologie, l’investigateur peut confier à un chirurgien-dentiste ou à un médecin le soin de communiquer à la personne qui se prête à cette étude des performances les informations susvisées et de recueillir son consentement.
