Article L1126-21 of the French Public Health Code

I.-Natural persons guilty of the offence referred to in article L. 1126-20 shall also be liable to the following penalties:

1° Disqualification from civic, civil and family rights, in accordance with the provisions ofarticle 131-26 of the French Criminal Code;

2° Disqualification, for a period of up to five years, from engaging in the professional or social activity in the course of which, or in the course of which, the offence was committed;

3° Disqualification from public contracts, either permanently or for a period of up to five years.

II – Legal entities found to be criminally liable, under the conditions set out inarticle 121-2 of the French Criminal Code, for the offence defined in article L. 1126-20 shall incur, in addition to a fine in accordance with the terms and conditions set out inarticle 131-38 of the French Criminal Code, the penalties set out in 1°, 2°, 4°, 9° and 12° of article 131-39 of the same code. The ban referred to in 2° of article 131-39 of the French Pen al Code applies to the activity in the course of which, or on the occasion of which, the offence was committed.

Article L1126-21

I.-Les personnes physiques coupables de l’infraction prévue à l’article L. 1126-20 encourent également les peines suivantes :

1° L’interdiction des droits civiques, civils et de famille, suivant les modalités prévues par l’article 131-26 du code pénal ;

2° L’interdiction, pour une durée de cinq ans au plus, d’exercer l’activité professionnelle ou sociale à l’occasion de laquelle ou dans l’exercice de laquelle l’infraction a été commise ;

3° L’exclusion des marchés publics à titre définitif ou pour une durée de cinq ans au plus.

II.-Les personnes morales déclarées responsables pénalement, dans les conditions prévues par l’article 121-2 du code pénal, de l’infraction définie à l’article L. 1126-20 encourent, outre l’amende suivant les modalités prévues par l’article 131-38 du code pénal, les peines prévues aux 1°, 2°, 4°, 9° et 12° de l’article 131-39 du même code. L’interdiction mentionnée au 2° de l’article 131-39 du code pénal porte sur l’activité dans l’exercice de laquelle ou à l’occasion de laquelle l’infraction a été commise.
