Article L1126-22 of the French Public Health Code

The following is punishable by one year’s imprisonment and a fine of 15,000 euros:

1° Without having obtained the favourable opinion of a committee for the protection of individuals and, in the case of performance studies mentioned in the second to fifth paragraphs of II of Article L. 1126-1, the authorisation of the competent authority;

2° Under conditions contrary to the provisions of article L. 1126-10;

3° Whose performance has been prohibited or suspended by the competent authority.

Any investigator who carries out such a performance study in breach of the provisions of article L. 1126-11 shall be liable to the same penalties.

Article L1126-22

Est puni d’un an d’emprisonnement et de 15 000 euros d’amende le fait de pratiquer ou de faire pratiquer une étude des performances :

1° Sans avoir obtenu l’avis favorable d’un comité de protection des personnes et, dans les cas d’études des performances mentionnées aux deuxième à cinquième alinéas du II de l’article L. 1126-1, l’autorisation de l’autorité compétente ;

2° Dans des conditions contraires aux dispositions de l’article L. 1126-10 ;

3° Dont la réalisation a été interdite ou suspendue par l’autorité compétente.

L’investigateur qui réalise une telle étude des performances en méconnaissance des dispositions de l’article L. 1126-11 est puni des mêmes peines.
