Dans le cadre d’une étude des performances comportant une intervention non justifiée par la prise en charge habituelle du participant et lui faisant encourir des risques et des contraintes non minimes, le fait pour le promoteur de ne pas fournir gratuitement aux investigateurs pendant la durée de l’étude des performances, les dispositifs médicaux de diagnostic in vitro faisant l’objet de l’étude des performances est puni de 30 000 euros d’amende.
