The performance study does not give rise to any direct or indirect financial compensation for the persons taking part, apart from the reimbursement of expenses incurred and, where applicable, compensation for the constraints suffered paid by the promoter. The total amount of compensation that a person may receive in any one year is limited to a maximum set by the Minister for Health.
The payment of such compensation is prohibited in the case of performance studies carried out on minors, persons under legal protection, adults unable to give their consent, persons deprived of their liberty, persons undergoing psychiatric care pursuant to Chapters II to IV of Title I of Book II of Part Three of this Code or Article 706-135 of the Code of Criminal Procedure and persons admitted to a health and social establishment for purposes other than performance studies.
Persons likely to take part in performance studies involving an intervention on the person that is not justified by his or her usual care and which exposes him or her to risks and constraints that are not minimal will benefit from a prior medical examination appropriate to the performance study. The results of this examination are communicated to them directly or through the intermediary of the doctor of their choice.
When the performance studies concern the field of midwifery, the results of this examination are communicated to them directly or through the intermediary of the doctor or midwife of their choice.
When the performance studies concern the field of dentistry, the results of this examination are communicated to them directly or through the intermediary of the doctor or dental surgeon of their choice.
The social security organisation has a claim against the promoter for payment of the benefits paid or provided.
