Article L1128-5 of the French Public Health Code

It is punishable by one year’s imprisonment and a fine of 15,000 euros to carry out or cause to be carried out research involving the human person:

1° Without having obtained a favourable opinion from a personal protection committee and, in the case of research mentioned in 1° of Article L. 1121-1, authorisation from the competent authority in accordance with Article L. 1121-4 or without having obtained the single decision mentioned in I of Article L. 1124-1 ;

2° Under conditions contrary to the provisions of article L. 1121-12 ;

3° Whose performance has been prohibited or suspended by the competent authority mentioned in article L. 1123-12.

Any investigator who carries out such research in breach of the provisions of article L. 1121-13 is liable to the same penalties.

Article L1128-5

Est puni d’un an d’emprisonnement et de 15 000 euros d’amende le fait de pratiquer ou de faire pratiquer une recherche impliquant la personne humaine :

1° Sans avoir obtenu l’avis favorable d’un comité de protection des personnes et, dans le cas de recherches mentionnées au 1° de l’article L. 1121-1, l’autorisation de l’autorité compétente conformément à l’article L. 1121-4 ou sans avoir obtenu la décision unique mentionnée au I de l’article L. 1124-1 ;

2° Dans des conditions contraires aux dispositions de l’article L. 1121-12 ;

3° Dont la réalisation a été interdite ou suspendue par l’autorité compétente mentionnée à l’article L. 1123-12.

L’investigateur qui réalise une telle recherche en infraction aux dispositions de l’article L. 1121-13 est puni des mêmes peines.
