Article L1130-3 of the French Public Health Code

By way of derogation from articles 16-10 and 16-11 of the Civil Code, when the person is incapable of expressing his or her wishes, the examination or identification may be undertaken for medical purposes in the interests of that person.

Prior to carrying out the examination or identification, the doctor shall ensure that the person has not previously objected to it to the trusted support person referred to in article L. 1111-6 of this Code, to his family or, failing that, to a close relative or, where applicable, to the person in charge of a legal protection measure with representation of the person.

Par dérogation aux articles 16-10 et 16-11 du code civil, lorsque la personne est hors d’état d’exprimer sa volonté, l’examen ou l’identification peut être entrepris à des fins médicales dans l’intérêt de cette personne.


Préalablement à la réalisation de l’examen ou de l’identification, le médecin s’assure que la personne ne s’y est pas opposée antérieurement auprès de la personne de confiance mentionnée à l’article L. 1111-6 du présent code, de sa famille ou, à défaut, d’un proche ou, le cas échéant, auprès de la personne chargée d’une mesure de protection juridique avec représentation à la personne.
