Article L1131-6 of the French Public Health Code

The following shall be determined by decree of the Conseil d’Etat :

1° The conditions under which, in the interests of patients and their relatives, examinations of a person’s genetic characteristics or their identification by genetic fingerprinting for medical purposes may be prescribed and carried out, as well as the conditions under which the examinations of somatic genetic characteristics referred to in Article L. 1130-2 may be prescribed;

2° The conditions for approval of the practitioners and persons mentioned in Article L. 1131-3;

3° The conditions for application of article L. 1131-1-2, after obtaining the opinion of the Agence de la biomédecine ;

4° The conditions to be met by the medical biology laboratories mentioned in Article L. 1131-2-1 in order to be authorised to carry out the examination of a person’s genetic characteristics or their identification by genetic fingerprinting for medical purposes.

Article L1131-6

Sont déterminées par décret en Conseil d’Etat :

1° Les conditions dans lesquelles peuvent être prescrits et réalisés, dans l’intérêt des patients et de leur parentèle, les examens des caractéristiques génétiques d’une personne ou son identification par empreintes génétiques à des fins médicales ainsi que les conditions dans lesquelles peuvent être prescrits les examens des caractéristiques génétiques somatiques mentionnées à l’article L. 1130-2 ;

2° Les conditions d’agrément des praticiens et personnes mentionnés à l’article L. 1131-3 ;

3° Les conditions d’application de l’article L. 1131-1-2, après avis de l’Agence de la biomédecine ;

4° Les conditions que doivent remplir les laboratoires de biologie médicale mentionnés à l’article L. 1131-2-1 pour être autorisés à pratiquer l’examen des caractéristiques génétiques d’une personne ou son identification par empreintes génétiques à des fins médicales.
