Differences of treatment on grounds of age do not constitute discrimination where they are objectively and reasonably justified by a legitimate aim, in particular by a concern to protect the health or safety of workers, to promote their integration into the labour market, to ensure their employment, redeployment or compensation in the event of loss of employment, and where the means of achieving that aim are necessary and appropriate.
These differences may in particular consist of :
1° The prohibition of access to employment or the establishment of special working conditions with a view to ensuring the protection of young people and older workers;
2° The fixing of a maximum age for recruitment, based on the training required for the post concerned or the need for a reasonable period of employment before retirement.
