Representative trade union organisations at national level, at departmental level or at local authority level in Guadeloupe, French Guyana, Martinique, Mayotte, La Réunion, Saint-Barthélemy and Saint-Martin, or in the company, may bring all legal actions resulting from the application of the provisions of Chapter II.
They may bring such actions on behalf of an applicant for a job, an internship or a training period in a company, or an employee, under the conditions set out in Article L. 1134-1.
The trade union organisation does not have to prove that it has a mandate from the person concerned. It is sufficient for the interested party to have been notified in writing of this action and not to have opposed it within a period of fifteen days from the date on which the trade union organisation notified him of its intention to act.
The person concerned may always intervene in the proceedings brought by the union.
