Where the damage suffered is of the serious nature referred to in II of Article L. 1142-1, the Commission will issue an opinion on the circumstances, causes, nature and extent of the damage, and on the applicable compensation scheme.
The opinion of the Regional Commission is issued within six months of the referral. It is sent to the person who referred the matter, to all persons involved in the dispute and to the office set up under article L. 1142-22.
This opinion may only be contested in the context of an action for compensation brought before the competent court by the victim, or in the context of the subrogation actions provided for in articles L. 1142-14, L. 1142-15 and L. 1142-17.
The Commission shall refer the matter to the competent authority if it finds any breaches that may give rise to disciplinary proceedings.
When the damage is the result of a nosocomial infection of the serious nature referred to in article L. 1142-1-1, the Commission shall immediately report this nosocomial infection to the Director General of the Regional Health Agency and to the Office instituted under article L. 1142-22.
