Article L115-26 of the French Cinema and Moving Image Code

Failure to comply with the obligations mentioned in Article L. 115-13 entails the application of a fine equal to 10% of the sums not communicated.

The fine may not be levied before the expiry of a period of thirty days from notification of the document by which the Centre national du cinéma et de l’image animée has informed the offender of the penalty it proposes to apply, the reasons for this penalty and the opportunity available to the interested party to submit his observations within this period.

The infringement is recorded and the fine is imposed, recovered, guaranteed and contested in accordance with the rules applicable to turnover taxes.

Le défaut de respect des obligations mentionnées à l’article L. 115-13 entraîne l’application d’une amende égale à 10 % des sommes non communiquées.

L’amende ne peut être mise en recouvrement avant l’expiration d’un délai de trente jours à compter de la notification du document par lequel le Centre national du cinéma et de l’image animée a fait connaître au contrevenant la sanction qu’il se propose d’appliquer, les motifs de celle-ci et la possibilité dont dispose l’intéressé de présenter ses observations dans ce délai.

Le manquement est constaté et l’amende est prononcée, recouvrée, garantie et contestée en suivant les règles applicables en matière de taxes sur le chiffre d’affaires.
