Article L122-12 of the French Intellectual Property Code

The approval of the organisations mentioned in the first paragraph of Article L. 122-10 is issued in consideration of:

the diversity of the members;

the professional qualifications of the directors;

the human and material resources they propose to implement to ensure the management of the reprographic reproduction right;

the equitable nature of the arrangements provided for the distribution of the sums collected.

A decree in the Conseil d’Etat shall lay down the procedures for issuing and withdrawing this approval and for choosing the transferee organisations pursuant to the last sentence of the first paragraph of Article L. 122-10.

Article L122-12

L’agrément des organismes mentionnés au premier alinéa de l’article L. 122-10 est délivré en considération :

-de la diversité des membres ;

-de la qualification professionnelle des dirigeants ;

-des moyens humains et matériels qu’ils proposent de mettre en oeuvre pour assurer la gestion du droit de reproduction par reprographie ;

-du caractère équitable des modalités prévues pour la répartition des sommes perçues.

Un décret en Conseil d’Etat fixe les modalités de la délivrance et du retrait de cet agrément ainsi que du choix des organismes cessionnaires en application de la dernière phrase du premier alinéa de l’article L. 122-10.
