Article L122-2-4 of the French Intellectual Property Code

A single act of representation constitutes the process by which, for the purpose of representation to the public, a broadcasting organisation, from the national territory or the territory of another Member State of the European Union, transmits its programme-carrying signals, in such a way that they are not accessible to the public during that transmission, to a signal distributor which transmits those programme-carrying signals to the public.

Under this single act of representation, the signal distributor and the broadcasting organisation must both, without joint and several liability between them, be authorised by the rightholders for the part of the act that each of these two entities performs.

Constitue un acte unique de représentation le processus par lequel, aux fins de représentation au public, un organisme de radiodiffusion, à partir du territoire national ou du territoire d’un autre Etat membre de l’Union européenne, transmet ses signaux porteurs de programmes, de telle sorte qu’ils ne soient pas accessibles au public au cours de cette transmission, à un distributeur de signaux qui transmet au public ces signaux porteurs de programmes.

Au titre de cet acte unique de représentation, le distributeur de signaux et l’organisme de radiodiffusion doivent l’un et l’autre, sans qu’il y ait entre eux de responsabilité solidaire, être autorisés par les titulaires de droits pour la part de l’acte que chacune de ces deux entités réalise.
