Article L1224-3-2 of the French Labour Code

Where an extended branch agreement provides for and organises the continuation of employment contracts in the event of a succession of companies in the performance of a contract, the employees of the new service provider cannot usefully invoke differences in remuneration resulting from advantages obtained, prior to the change of service provider, by the employees whose employment contracts have been continued.

Lorsqu’un accord de branche étendu prévoit et organise la poursuite des contrats de travail en cas de succession d’entreprises dans l’exécution d’un marché, les salariés du nouveau prestataire ne peuvent invoquer utilement les différences de rémunération résultant d’avantages obtenus, avant le changement de prestataire, par les salariés dont les contrats de travail ont été poursuivis.
