If the employer is unable to offer the employee another job, it shall inform her and the company doctor in writing of the reasons for the temporary assignment.
The employee’s employment contract is then suspended until the date of commencement of maternity leave and, where she has given birth, for the period not exceeding one month provided for in 2° of article L. 1225-12.
The employee benefits from guaranteed remuneration during the suspension of the employment contract, consisting of the daily allowance provided for in article L. 333-1 of the Social Security Code and a supplementary allowance payable by the employer, in accordance with the same terms and conditions as those provided for by the provisions mentioned in article L. 1226-1, with the exception of the provisions relating to seniority.
