Article L1225-26 of the French Labour Code

In the absence of a collective agreement at branch or company level setting guarantees for the development of employees’ pay during maternity leave and following such leave that are at least as favourable as those mentioned in this article, such pay, within the meaning of article L. 3221-3, is increased, following such leave, by general increases as well as by the average of individual increases received during the period of such leave by employees in the same professional category or, failing that, by the average of individual increases in the company.

This rule does not apply to collective branch or company agreements concluded prior to the entry into force of law no. 2006-340 of 23 March 2006 on equal pay for men and women.

Article L1225-26

En l’absence d’accord collectif de branche ou d’entreprise déterminant des garanties d’évolution de la rémunération des salariées pendant le congé de maternité et à la suite de ce congé au moins aussi favorables que celles mentionnées dans le présent article, cette rémunération, au sens de l’article L. 3221-3, est majorée, à la suite de ce congé, des augmentations générales ainsi que de la moyenne des augmentations individuelles perçues pendant la durée de ce congé par les salariés relevant de la même catégorie professionnelle ou, à défaut, de la moyenne des augmentations individuelles dans l’entreprise.

Cette règle n’est pas applicable aux accords collectifs de branche ou d’entreprise conclus antérieurement à l’entrée en vigueur de la loi n° 2006-340 du 23 mars 2006 relative à l’égalité salariale entre les femmes et les hommes.
