Article L1225-28 of the French Labour Code

In the event of the death of the mother during the period of compensation defined in the first paragraph of article L. 331-6 of the Social Security Code, the father may suspend his employment contract for a period at most equal to the remaining period of compensation defined in the same first paragraph, where applicable deferred in application of the second paragraph of the same article.

The person concerned shall notify his employer of the reason for his absence and the date on which he intends to end the suspension of his employment contract. The father then benefits from the protection against dismissal provided for in articles L. 1225-4 and L. 1225-5 .

If the father of the child does not exercise his right, the benefit of this right is granted to the mother’s employed spouse or to the employed person linked to her by a civil solidarity pact or living in a marital relationship with her.

Article L1225-28

En cas de décès de la mère au cours de la période d’indemnisation définie au premier alinéa de l’article L. 331-6 du code de la sécurité sociale, le père peut suspendre son contrat de travail pendant une période au plus égale à la durée d’indemnisation restant à courir, définie au même premier alinéa, le cas échéant reportée en application du deuxième alinéa du même article.

L’intéressé avertit son employeur du motif de son absence et de la date à laquelle il entend mettre fin à la suspension de son contrat de travail. Le père bénéficie alors de la protection contre le licenciement prévue aux articles L. 1225-4 et L. 1225-5.

Lorsque le père de l’enfant n’exerce pas son droit, le bénéfice de celui-ci est accordé au conjoint salarié de la mère ou à la personne salariée liée à elle par un pacte civil de solidarité ou vivant maritalement avec elle.
