Article L1225-4-2 of the French Labour Code

No employer may terminate an employee’s employment contract during the thirteen weeks following the death of the employee’s child under the age of twenty-five or of the person under the age of twenty-five for whom the employee has actual and permanent responsibility.

However, the employer may terminate the contract if it can prove that the employee is guilty of serious misconduct or that it is impossible to continue the contract for reasons unrelated to the death of the child.

Aucun employeur ne peut rompre le contrat de travail d’un salarié pendant les treize semaines suivant le décès de son enfant âgé de moins de vingt-cinq ans ou de la personne âgée de moins de vingt-cinq ans dont le salarié a la charge effective et permanente.


Toutefois, l’employeur peut rompre le contrat s’il justifie d’une faute grave de l’intéressé ou de son impossibilité de maintenir ce contrat pour un motif étranger au décès de l’enfant.
