Article L1225-52 of the French Labour Code

In the event of the death of the child or a significant reduction in household resources, the employee has the right:

1° If he/she is on parental education leave, either to return to his/her original job, or to work part-time up to the limit of the period initially stipulated in the employment contract;

2° If he/she works part-time to raise a child, to resume his/her initial activity and, with the employer’s agreement, to change the duration.

The employee shall send a reasoned request to the employer at least one month before the date on which he intends to benefit from these provisions.

En cas de décès de l’enfant ou de diminution importante des ressources du foyer, le salarié a le droit :

1° S’il bénéficie du congé parental d’éducation, soit de reprendre son activité initiale, soit d’exercer son activité à temps partiel dans la limite de la durée initialement prévue par le contrat de travail ;

2° S’il travaille à temps partiel pour élever un enfant, de reprendre son activité initiale et, avec l’accord de l’employeur, d’en modifier la durée.

Le salarié adresse une demande motivée à l’employeur un mois au moins avant la date à laquelle il entend bénéficier de ces dispositions.
