Article L1226-4-1 of the French Labour Code

In the event of dismissal in the circumstances referred to in Article L. 1226-2-1, the compensation due to the employee in respect of the termination of employment shall be paid either directly by the employer, or by means of the cover it has subscribed to a mutual fund.

The management of this fund is entrusted to the association provided for in article L. 3253-14.

En cas de licenciement prononcé dans le cas visé à l’article L. 1226-2-1, les indemnités dues au salarié au titre de la rupture sont prises en charge soit directement par l’employeur, soit au titre des garanties qu’il a souscrites à un fonds de mutualisation.

La gestion de ce fonds est confiée à l’association prévue à l’article L. 3253-14.
