The rights referred to in article L. 123-1 which became legally enforceable against third parties before the entry into force of law no. 90 of 22 February 1944 are maintained in their previous rank if they have been registered within three months of the said entry into force.
Failing this, they only rank with regard to third parties under the conditions set out in Article L. 123-5.
By way of derogation from the provisions of the first paragraph of article L. 123-1, the registrations referred to in this article shall be accepted on production of a certificate issued by the President of the Centre national du cinéma et de l’image animée, in the event that, one month after formal notice has been served on the producer by registered letter, the applicant has been unable to obtain from the latter a certificate specifying the serial number assigned to the cinematographic work in question, in accordance with article L. 122-1. Production of this certificate replaces the formality of filing the title provided for in the said article L. 122-1.
