Article L1233-13 of the French Labour Code

During the hearing, the employee may be assisted by a person of his choice from among the company’s staff.

Where there are no staff representative bodies in the company, the employee may be assisted either by a person of his choice from among the company’s staff, or by an employee adviser chosen from a list drawn up by the administrative authority.

The letter convening the employee to the preliminary interview mentions the possibility of having recourse to an advisor and specifies the address of the departments where the list of advisors is kept available to employees.

Lors de son audition, le salarié peut se faire assister par une personne de son choix appartenant au personnel de l’entreprise.

Lorsqu’il n’y a pas d’institutions représentatives du personnel dans l’entreprise, le salarié peut se faire assister soit par une personne de son choix appartenant au personnel de l’entreprise, soit par un conseiller du salarié choisi sur une liste dressée par l’autorité administrative.

La lettre de convocation à l’entretien préalable adressée au salarié mentionne la possibilité de recourir à un conseiller et précise l’adresse des services où la liste des conseillers est tenue à la disposition des salariés.
