An employer who has informed the social and economic committee of a plan to close a plant must look for a buyer. The employer is required to
1° Inform potential buyers, by any appropriate means, of its intention to sell the business;
2° Immediately produce a document presenting the business to potential buyers;
3° Where applicable, initiate the environmental assessment referred to in article L. 623-1 of the French Commercial Code. This assessment must provide a precise diagnosis of the pollution caused by the establishment’s activities and present the possible clean-up solutions and their cost;
4° To give access to all necessary information to the companies applying to take over the facility, with the exception of information the disclosure of which would be likely to harm the interests of the company or would jeopardise the continuation of its business as a whole. Companies applying to take over the business are bound by an obligation of confidentiality;
5° Examine the takeover offers received;
6° Provide a reasoned response to each of the takeover offers received, within the deadlines set out in Article L. 1233-30.
