Article L1233-57-17 of the French Labour Code

The social and economic committee can call on the assistance of an expert of its choice, paid for by the company.

The task of this expert is to analyse the process of finding a buyer, its methodology and scope, to assess the information made available to potential buyers, to study takeover offers and to provide assistance in the search for a buyer by the social and economic committee and in the development of takeover projects.

The expert submits his report within the timeframe set out in Article L. 1233-30.

When the social and economic committee calls on the assistance of an expert, the employer informs the administrative authority without delay.

Le comité social et économique peut recourir à l’assistance d’un expert de son choix rémunéré par l’entreprise.

Cet expert a pour mission d’analyser le processus de recherche d’un repreneur, sa méthodologie et son champ, d’apprécier les informations mises à la disposition des repreneurs potentiels, d’étudier les offres de reprise et d’apporter son concours à la recherche d’un repreneur par le comité social et économique et à l’élaboration de projets de reprise.

L’expert présente son rapport dans les délais prévus à l’article L. 1233-30.

Lorsque le comité social et économique recourt à l’assistance d’un expert, l’employeur en informe sans délai l’autorité administrative.
