Article L1233-57-20 of the French Labour Code

Before the end of the information and consultation procedure provided for in article L. 1233-30, if no takeover offer has been received or if the employer has not wished to take up any of the offers, the employer shall call a meeting of the social and economic committee and present it with a report, which shall be sent to the administrative authority. This report indicates

1° The steps taken to find a buyer ;

2° The takeover offers received and their characteristics;

3° The reasons that led it, where applicable, to refuse the sale of the establishment.

Avant la fin de la procédure d’information et de consultation prévue à l’article L. 1233-30, si aucune offre de reprise n’a été reçue ou si l’employeur n’a souhaité donner suite à aucune des offres, celui-ci réunit le comité social et économique et lui présente un rapport, qui est communiqué à l’autorité administrative. Ce rapport indique :

1° Les actions engagées pour rechercher un repreneur ;

2° Les offres de reprise qui ont été reçues ainsi que leurs caractéristiques ;

3° Les motifs qui l’ont conduit, le cas échéant, à refuser la cession de l’établissement.
