Article L1233-57-21 of the French Labour Code

The actions undertaken by the employer under the obligation to find a buyer are taken into account in the revitalisation agreement concluded between the company and the administrative authority pursuant to articles L. 1233-84 to L. 1233-90.

Having regard to the employer’s ability to avoid redundancies or to limit the number of redundancies by selling the establishment concerned by the closure project, as attested by the reports mentioned in articles L. 1233-57-17 and L. 1233-57-20, the administrative authority may request the reimbursement of pecuniary aid for installation, economic development, research or employment granted by a public person to the company, in respect of the establishment concerned by the closure project, during the two years preceding the meeting provided for in I of Article L. 1233-30 and after the entry into force of Law No. 2014-856 of 31 July 2014 on the social and solidarity economy.

Les actions engagées par l’employeur au titre de l’obligation de recherche d’un repreneur sont prises en compte dans la convention de revitalisation conclue entre l’entreprise et l’autorité administrative en application des articles L. 1233-84 à L. 1233-90.

Eu égard à la capacité de l’employeur à éviter les licenciements ou à en limiter le nombre par la cession de l’établissement concerné par le projet de fermeture, attestée par les rapports mentionnés aux articles L. 1233-57-17 et L. 1233-57-20, l’autorité administrative peut demander le remboursement des aides pécuniaires en matière d’installation, de développement économique, de recherche ou d’emploi attribuées par une personne publique à l’entreprise, au titre de l’établissement concerné par le projet de fermeture, au cours des deux années précédant la réunion prévue au I de l’article L. 1233-30 et après l’entrée en vigueur de la loi n° 2014-856 du 31 juillet 2014 relative à l’économie sociale et solidaire.
