Article L1233-57 of the French Labour Code

The administrative authority may submit any proposal to complete or modify the job protection plan, taking into account the economic situation of the company.

These proposals are formulated before the last meeting of the Social and Economic Committee. They are communicated to the employer and to the social and economic committee. The employer sends a reasoned response to the administrative authority.

In the absence of staff representatives, these proposals and the employer’s reasoned response to them, which it sends to the administrative authority, are brought to the attention of employees by means of posters in the workplace.

L’autorité administrative peut présenter toute proposition pour compléter ou modifier le plan de sauvegarde de l’emploi, en tenant compte de la situation économique de l’entreprise.

Ces propositions sont formulées avant la dernière réunion du comité social et économique. Elles sont communiquées à l’employeur et au comité social et économique. L’employeur adresse une réponse motivée à l’autorité administrative.

En l’absence de représentants du personnel, ces propositions ainsi que la réponse motivée de l’employeur à celles-ci, qu’il adresse à l’autorité administrative, sont portées à la connaissance des salariés par voie d’affichage sur les lieux de travail.
