Article L1234-6 of the French Labour Code

In the event of total or partial non-fulfilment of the notice period resulting either from the temporary or definitive closure of the establishment, or from the reduction of the working hours usually worked in the establishment below the legal working hours, the salary to be taken into consideration is calculated on the basis of the legal or contractual working hours applicable to the company, when the employee was working full-time, or the working hours set out in his employment contract when he was working part-time.

En cas d’inexécution totale ou partielle du préavis résultant soit de la fermeture temporaire ou définitive de l’établissement, soit de la réduction de l’horaire de travail habituellement pratiqué dans l’établissement en deçà de la durée légale de travail, le salaire à prendre en considération est calculé sur la base de la durée légale ou conventionnelle de travail applicable à l’entreprise, lorsque le salarié travaillait à temps plein, ou de la durée du travail fixée dans son contrat de travail lorsqu’il travaillait à temps partiel.
