Article L1235-2-1 of the French Labour Code

In the event of multiple grounds for dismissal, if one of the grievances alleged against the employee infringes a fundamental freedom, the nullity of the termination does not exempt the court from examining all of the grievances set out, in order to take them into account, where applicable, in its assessment of the compensation to be awarded to the employee, without prejudice to the provisions ofarticle L. 1235-3-1.

En cas de pluralité de motifs de licenciement, si l’un des griefs reprochés au salarié porte atteinte à une liberté fondamentale, la nullité encourue de la rupture ne dispense pas le juge d’examiner l’ensemble des griefs énoncés, pour en tenir compte, le cas échéant, dans l’évaluation qu’il fait de l’indemnité à allouer au salarié, sans préjudice des dispositions de l’article L. 1235-3-1.
