Article L1237-4 of the French Labour Code

Provisions relating to the retirement of employees contained in a collective agreement, a collective labour agreement or an employment contract are applicable provided that they do not conflict with legal provisions.

Any stipulation in a collective labour agreement or contract of employment that provides for the automatic termination of an employee’s contract of employment on the grounds of age or entitlement to an old-age pension is null and void.

Les stipulations relatives au départ à la retraite des salariés prévues par une convention collective, un accord collectif de travail ou un contrat de travail sont applicables sous réserve qu’elles ne soient pas contraires aux dispositions légales.

Sont nulles toutes stipulations d’une convention ou d’un accord collectif de travail et d’un contrat de travail prévoyant une rupture de plein droit du contrat de travail d’un salarié en raison de son âge ou du fait qu’il serait en droit de bénéficier d’une pension de vieillesse.
