Article L1243-13 of the French Labour Code

An agreement or an extended branch agreement may set the maximum number of renewals possible for a fixed-term employment contract. This number may neither have the purpose nor the effect of permanently filling a job linked to the normal and permanent activity of the company.

The conditions for renewal are stipulated in the contract or are the subject of an amendment submitted to the employee before the term initially provided for.

These provisions do not apply to fixed-term employment contracts concluded in application ofarticle L. 1242-3.

Article L1243-13

Une convention ou un accord de branche étendu peut fixer le nombre maximal de renouvellements possibles pour un contrat de travail à durée déterminée. Ce nombre ne peut avoir ni pour objet ni pour effet de pourvoir durablement un emploi lié à l’activité normale et permanente de l’entreprise.


Les conditions de renouvellement sont stipulées dans le contrat ou font l’objet d’un avenant soumis au salarié avant le terme initialement prévu.


Ces dispositions ne sont pas applicables au contrat de travail à durée déterminée conclu en application de l’article L. 1242-3.
