Any violation observed in an establishment or organisation, and caused by it, of the legislative and regulatory requirements relating to the removal and transplantation of organs, the removal of tissues and cells, the preservation, preparation, import and export of tissues or cell therapy preparations, as well as the transplantation of these tissues or the administration of these preparations, shall result in the suspension or withdrawal of the authorisations provided for in articles L. 1233-1, L. 1234-2, L. 1242-1, L. 1243-2, L. 1243-4, L. 1243-6, L. 1245-5 and L. 1245-5-1.
Withdrawal may only take place after a period of one month following a formal notice sent by the administrative authority to the establishment or organisation specifying the complaints made against it. In urgent cases involving the safety of the persons concerned, a provisional suspension may be ordered as a precautionary measure.
The withdrawal decision is published in the Journal officiel de la République française.
The temporary or definitive withdrawal of the authorisations mentioned in articles L. 1233-1, L. 1242-1 and L. 1243-4 is automatic when requested by the Agence nationale de sécurité du médicament et des produits de santé.
