Article L1245-8 of the French Public Health Code

The provisions of this Title apply to army hospitals, the army blood transfusion centre and other elements of the army health service. They apply, where applicable, to other elements of the Ministry of Defence with missions involving the removal, collection, preparation, preservation and use of tissues, cells or their derivatives.

A Conseil d’Etat decree determines the adaptations that may be made:

1° With regard to army hospitals and the army blood transfusion centre, to the declaration and authorisation procedures applicable to health establishments, blood transfusion establishments and establishments or organisations authorised under articles L. 1243-2 and L. 1245-5;

2° With regard to the other elements of the armed forces health service and the other elements of the Ministry of Defence with missions of removal, collection, preparation, conservation and use of tissues, cells or their derivatives, subject to the declaration and authorisation procedures of this title relating to the conservation and preparation for scientific purposes of tissues and cells from the human body.

Article L1245-8

Les dispositions du présent titre s’appliquent aux hôpitaux des armées, au centre de transfusion sanguine des armées ainsi qu’aux autres éléments du service de santé des armées. Elles s’appliquent, le cas échéant, à d’autres éléments du ministère de la défense ayant des missions de prélèvement, collecte, préparation, conservation et utilisation des tissus, des cellules ou de leurs dérivés.

Un décret en Conseil d’Etat détermine les adaptations qui peuvent être apportées :

1° En ce qui concerne les hôpitaux des armées et le centre de transfusion sanguine des armées, aux procédures de déclaration et d’autorisation applicables aux établissements de santé, aux établissements de transfusion sanguine et aux établissements ou organismes autorisés au titre des articles L. 1243-2 et L. 1245-5 ;

2° En ce qui concerne les autres éléments du service de santé des armées et les autres éléments du ministère de la défense ayant des missions de prélèvement, collecte, préparation, conservation et utilisation des tissus, des cellules ou de leurs dérivés, soumis aux procédures de déclaration et d’autorisation du présent titre relatives à la conservation et la préparation à des fins scientifiques de tissus et cellules issus du corps humain.
