Article L1248-1 of the French Labour Code

Any person who, contrary to article L. 1242-1, concludes a fixed-term employment contract whose purpose or effect is to permanently fill a job linked to the normal and permanent activity of the company, is liable to a fine of 3,750 euros.

A repeat offence is punishable by a fine of 7,500 euros and six months’ imprisonment.

Le fait de conclure un contrat de travail à durée déterminée qui a pour objet ou pour effet de pourvoir durablement un emploi lié à l’activité normale et permanente de l’entreprise, en méconnaissance de l’article L. 1242-1, est puni d’une amende de 3 750 euros.

La récidive est punie d’une amende de 7 500 euros et d’un emprisonnement de six mois.
