Article L1248-4 of the French Labour Code

Any person who concludes a fixed-term employment contract that does not include a term fixed precisely at the time it is concluded, in breach of article L. 1242-7, is liable to a fine of 3,750 euros.

The same penalty applies if the employer concludes such a contract without setting a minimum duration, when it does not include a precise term.

A repeat offence is punishable by a fine of €7,500 and six months’ imprisonment.

Le fait de conclure un contrat de travail à durée déterminée ne comportant pas un terme fixé avec précision dès sa conclusion, en méconnaissance de l’article L. 1242-7, est puni d’une amende de 3 750 euros.

Le fait pour l’employeur de conclure un tel contrat sans fixer de durée minimale, lorsqu’il ne comporte pas de terme précis, est puni de la même peine.

La récidive est punie d’une amende de 7 500 euros et d’un emprisonnement de six mois.
