Article L1248-8 of the French Labour Code

Paying an employee holding a fixed-term employment contract less than the remuneration that would be received in the same company, after the trial period, by an employee holding an open-ended employment contract with equivalent professional qualifications and performing the same duties, in breach of article L. 1242-15, is punishable by a fine of 3,750 euros.

A repeat offence is punishable by a fine of 7,500 euros and six months’ imprisonment.

Le fait de verser au salarié titulaire d’un contrat de travail à durée déterminée une rémunération inférieure au montant de la rémunération que percevrait dans la même entreprise, après période d’essai, un salarié bénéficiant d’un contrat de travail à durée indéterminée de qualification professionnelle équivalente et occupant les mêmes fonctions en méconnaissance de l’article L. 1242-15 est puni d’une amende de 3 750 euros.

La récidive est punie d’une amende de 7 500 euros et d’un emprisonnement de six mois.
