Article L1251-36 of the French Labour Code

When an assignment contract expires, neither a fixed-term contract nor an assignment contract may be used to fill the position of the employee whose contract has expired, before the expiry of a waiting period calculated on the basis of the duration of the assignment contract including, where applicable, its renewal(s). The days taken into account are the days on which the user company or establishment is open for business.

Without prejudice to the provisions ofarticle L. 1251-5, the agreement or the extended branch agreement of the user company may set the terms and conditions for calculating this waiting period.

A l’expiration d’un contrat de mission, il ne peut être recouru, pour pourvoir le poste du salarié dont le contrat a pris fin, ni à un contrat à durée déterminée ni à un contrat de mission, avant l’expiration d’un délai de carence calculé en fonction de la durée du contrat de mission incluant, le cas échéant, son ou ses renouvellements. Les jours pris en compte sont les jours d’ouverture de l’entreprise ou de l’établissement utilisateurs.


Sans préjudice des dispositions de l’article L. 1251-5, la convention ou l’accord de branche étendu de l’entreprise utilisatrice peut fixer les modalités de calcul de ce délai de carence.
