Article L1251-62 of the French Labour Code

If the legal entity governed by public law continues to employ an employee of a temporary employment agency after the end of his assignment without having concluded a contract with him or without a new assignment contract, this employee is deemed to be linked to the legal entity governed by public law by a three-year fixed-term contract. In this case, the employee’s seniority is assessed from the first day of the assignment. This is deducted from any trial period.

Si la personne morale de droit public continue à employer un salarié d’une entreprise de travail temporaire après la fin de sa mission sans avoir conclu avec lui un contrat ou sans nouveau contrat de mise à disposition, ce salarié est réputé lié à la personne morale de droit public par un contrat à durée déterminée de trois ans. Dans ce cas, l’ancienneté du salarié est appréciée à compter du premier jour de sa mission. Elle est déduite de la période d’essai éventuellement prévue.
