Article L1255-13 of the French Labour Code

Failure to comply with the provisions of articles L. 1253-1 to L. 1253-10 and L. 1253-17 is punishable by a fine of 3,750 euros.

A repeat offence is punishable by six months’ imprisonment and a fine of €7,500.

The court may also order, as an additional penalty, the posting of the judgment at the expense of the convicted person, at the door of the head office of the group and at the doors of the user companies, under the conditions set out in article 131-35 of the French Criminal Code, and its publication, in full or in extracts, in the newspapers that it designates. These costs may not exceed the maximum amount of the fine incurred.

Le fait de méconnaître les dispositions des articles L. 1253-1 à L. 1253-10 et L. 1253-17, est puni d’une amende de 3 750 euros.

La récidive est punie d’un emprisonnement de six mois et d’une amende de 7 500 euros.

La juridiction peut également ordonner, à titre de peine complémentaire, l’affichage du jugement aux frais de la personne condamnée, à la porte du siège du groupement et aux portes des entreprises utilisatrices, dans les conditions prévues à l’article 131-35 du code pénal, et son insertion, intégrale ou par extraits, dans les journaux qu’elle désigne. Ces frais ne peuvent excéder le montant maximum de l’amende encourue.
