Article L1261-1 of the French Public Health Code

A person of full age may consent to donate their body after their death for the purposes of medical teaching and research. The donor’s consent must be expressed in writing. This paragraph does not apply to persons of full age who are the subject of a legal protection measure with representation relating to the person.

This donation may only be made to a health, training or research establishment holding an authorisation issued by the ministers responsible for this establishment.

The conditions for the opening, organisation and operation of these structures are defined by decree in the Conseil d’Etat. In particular, this decree specifies the conditions under which the cost of transporting the body will be covered. It also specifies the conditions for returning bodies that have been donated, taking into account the donor’s wishes and informing and involving the donor’s family in the decisions.

Health, training and research establishments undertake to treat the bodies entrusted to them with respect and dignity.

Une personne majeure peut consentir à donner son corps après son décès à des fins d’enseignement médical et de recherche. Le consentement du donneur est exprimé par écrit. Le présent alinéa ne s’applique pas aux personnes majeures faisant l’objet d’une mesure de protection juridique avec représentation relative à la personne.

Ce don ne peut être effectué qu’au bénéfice d’un établissement de santé, de formation ou de recherche titulaire d’une autorisation délivrée par les ministres de tutelle de cet établissement.

Les conditions d’ouverture, d’organisation et de fonctionnement de ces structures sont définies par décret en Conseil d’Etat. Ce décret précise notamment les conditions de prise en charge financière du transport des corps. Il précise également les conditions de restitution des corps ayant fait l’objet d’un tel don en prenant en compte la volonté du donneur ainsi qu’en informant et en associant sa famille aux décisions.

Les établissements de santé, de formation ou de recherche s’engagent à apporter respect et dignité aux corps qui leur sont confiés.
