Article L1271-2 of the French Public Health Code

Taking or attempting to take blood from a living person without that person’s consent is punishable by five years’ imprisonment and a fine of 150,000 euros.

The same penalties shall apply to taking or attempting to take blood in breach of the provisions of article L. 1221-5 from a minor or a person of full age who is the subject of a legal protection measure with representation relating to the person.

Le fait de prélever ou de tenter de prélever du sang sur une personne vivante sans qu’elle ait exprimé son consentement est puni de cinq ans d’emprisonnement et de 150 000 euros d’amende.

Est puni des mêmes peines le fait de prélever ou de tenter de prélever du sang en violation des dispositions de l’article L. 1221-5 sur une personne mineure ou sur une personne majeure faisant l’objet d’une mesure de protection juridique avec représentation relative à la personne.
