Article L1271-5 of the French Public Health Code

Altering or attempting to alter the characteristics of a person’s blood prior to sampling in breach of the provisions of article L. 1221-6 is punishable by a fine of 45,000 euros. In the event of a repeat offence, a six-month prison sentence may also be imposed.

The same penalties shall apply to contravening or attempting to contravene the obligation imposed by article L. 1222-9 on the Etablissement Français du Sang to take out insurance to cover its liability for the risks incurred by donors as a result of blood collection operations.

La modification ou la tentative de modification des caractéristiques du sang d’une personne avant prélèvement en infraction aux dispositions de l’article L. 1221-6 est punie de 45 000 euros d’amende. En cas de récidive, une peine d’emprisonnement de six mois peut en outre être prononcée.

Est puni des mêmes peines le fait de contrevenir ou de tenter de contrevenir à l’obligation prescrite par l’article L. 1222-9 à l’Etablissement français du sang de contracter une assurance couvrant sa responsabilité du fait des risques encourus par les donneurs à raison des opérations de prélèvement.
