Article L1272-4-2 of the French Public Health Code

As stated in Article 511-5-2 of the Criminal Code, reproduced below:

Art. 511-5-2.-I.-The act of preserving and processing organs, tissues, cells or blood, its components and derived products for scientific purposes, including genetic research, is punishable by five years’ imprisonment and a fine of 75,000 euros:

1° Without having made the prior declaration provided for in article L. 1243-3 of the Public Health Code ;

2° While the Minister in charge of research has opposed the exercise of these activities or has suspended or prohibited them.

II – The same penalties apply to the storage and processing, with a view to their transfer for scientific use, including for genetic research purposes, of organs, tissues, cells or blood, its components and derived products without having first obtained the authorisation provided for in article L. 1243-4 of the Public Health Code or while this authorisation is suspended or withdrawn.

Comme il est dit à l’article 511-5-2 du code pénal ci-après reproduit :

Art. 511-5-2.-I.-Est puni de cinq ans d’emprisonnement et de 75 000 euros d’amende le fait de conserver et transformer à des fins scientifiques, y compris à des fins de recherche génétique, des organes, des tissus, des cellules ou du sang, ses composants et ses produits dérivés :

1° Sans en avoir fait la déclaration préalable prévue à l’article L. 1243-3 du code de la santé publique ;

2° Alors que le ministre chargé de la recherche s’est opposé à l’exercice de ces activités ou les a suspendues ou interdites.

II.-Est puni des mêmes peines le fait de conserver et transformer, en vue de leur cession pour un usage scientifique, y compris à des fins de recherche génétique, des organes, des tissus, des cellules ou du sang, ses composants et ses produits dérivés sans avoir préalablement obtenu l’autorisation prévue à l’article L. 1243-4 du code de la santé publique ou alors que cette autorisation est suspendue ou retirée.
