Article L1311-6 of the French General Code of Local Authorities

The real right conferred by the title, the works, constructions and installations of an immovable nature may not be assigned, or transferred in the context of inter vivos transfers or mergers, takeovers or demergers of companies, for the remaining period of validity of the title, including in the case of the realisation of the security relating to the said rights and property and in the cases provided for in the first and second paragraphs of Article L. 1311-6-1, than to a person approved by the local authorities, their groupings and their public establishments, with a view to use compatible with the purpose of the public domain occupied.

In the event of the death of a natural person holding a title of occupation constituting a real right, this may be transferred, under the conditions provided for in the previous paragraph, to the surviving spouse or heirs provided that the beneficiary, designated by agreement between them, is presented for approval by the competent authority within six months of the death.

Le droit réel conféré par le titre, les ouvrages, constructions et installations de caractère immobilier ne peuvent être cédés, ou transmis dans le cadre de mutations entre vifs ou de fusion, absorption ou scission de sociétés, pour la durée de validité du titre restant à courir, y compris dans le cas de réalisation de la sûreté portant sur lesdits droits et biens et dans les cas prévus aux premier et deuxième alinéas de l’article L. 1311-6-1, qu’à une personne agréée par les collectivités territoriales, leurs groupements et leurs établissements publics, en vue d’une utilisation compatible avec l’affectation du domaine public occupé.

Lors du décès d’une personne physique titulaire d’un titre d’occupation constitutif de droit réel, celui-ci peut être transmis, dans les conditions prévues à l’alinéa précédent, au conjoint survivant ou aux héritiers sous réserve que le bénéficiaire, désigné par accord entre eux, soit présenté à l’agrément de l’autorité compétente dans un délai de six mois à compter du décès.
