The author and publisher holding the right to reproduce an unavailable book in printed form shall jointly notify the collective management organisation mentioned in Article L. The author of an unavailable book may decide at any time to withdraw from the collective management organisation mentioned in the same article L. 134-3 the right to authorise the reproduction and representation of the book in digital form. It shall notify the organisation of this decision.
Note of the notifications provided for in the first two paragraphs of this Article shall be made in the database mentioned in article L. 134-2.
The publisher who has notified his decision under the conditions provided for in the first paragraph is required to exploit the book concerned within eighteen months of this notification. It must provide the collective management organisation, by any means, with proof of the actual exploitation of the book.
The organisation shall inform all users to whom it has granted authorisation to exploit the book concerned of the decisions referred to in the first two paragraphs of this Article. The user shall terminate the exploitation of the book as soon as possible and no later than three months following notification of this information.
