Article L139-1 of the French Intellectual Property Code

Under the conditions provided for in articles L. 324-8-1 to L. 324-8-6, the contract by which an approved collective management organisation authorises the reproduction and representation of the works mentioned in 7° to 12° of article L. 112-2, for the exclusive purpose of illustrating publications or works, distributed online without restriction of access, as part of a research and higher education activity covered by articles L. 123-1 and L. 732-1 of the Education Code or Article L. 112-2 of the Research Code, to the exclusion of any profit-making activity, may be extended to right holders who are not members of this organisation by order of the minister responsible for culture.

The approved collective management organisation informs the copyright owner of the use of its works.
The approved collective management organisation informs the signatories of agreements authorising the acts of exploitation mentioned in the previous paragraph of oppositions notified to it under the conditions provided for in article L. 324-8-2.

Article L139-1

Dans les conditions prévues aux articles L. 324-8-1 à L. 324-8-6, le contrat par lequel un organisme de gestion collective agréé autorise la reproduction et la représentation des œuvres mentionnées aux 7° à 12° de l’article L. 112-2, à des fins exclusives d’illustration de publications ou de travaux, diffusés en ligne sans restriction d’accès, dans le cadre d’une activité de recherche et d’enseignement supérieur relevant des articles L. 123-1 et L. 732-1 du code de l’éducation ou de l’article L. 112-2 du code de la recherche, à l’exclusion de toute activité à but lucratif, peut être étendu aux titulaires de droits non membres de cet organisme par arrêté du ministre chargé de la culture.

L’organisme de gestion collective agréé informe les signataires d’accords autorisant les actes d’exploitation mentionnés à l’alinéa précédent des oppositions qui lui ont été notifiées dans les conditions prévues à l’article L. 324-8-2.
