Article L141-16 of the French Commercial code

If the objection has been made without title and without cause or is null and void in form and if there are no proceedings instituted in the main proceedings, the seller may appeal to the president of the court in summary proceedings to obtain authorisation to collect his price, despite the objection.

Si l’opposition a été faite sans titre et sans cause ou est nulle en la forme et s’il n’y a pas instance engagée au principal, le vendeur peut se pourvoir en référé devant le président du tribunal, à l’effet d’obtenir l’autorisation de toucher son prix, malgré l’opposition.
