The Agency’s staff are governed by the provisions of articles L. 5323-1 to L. 5323-4.
The members of the Agency’s Board of Directors and any other persons in possession of information held by the Agency are bound by professional secrecy under the conditions and subject to the penalties laid down in articles 226-13 and 226-14 of the French Penal Code.
In addition, members of the Steering Committee, groups of experts or any other committee sitting within the Agency may not, subject to the penalties laid down inarticle 432-12 of the Criminal Code, take part in the deliberations or votes of these bodies if they have a direct or indirect interest in the matter being examined. This declaration is updated on their own initiative as soon as there is a change in these links or new links are established. It is made public. The operating rules of these bodies guaranteeing the independence of their members and the absence of conflicts of interest shall be laid down by regulation.
The Ministers for Health and Research and the Director General of the Agency may respectively terminate the functions of the members of the Advisory Board mentioned in 2° to 4° of Article L. 1418-4 and the members of the groups and commissions mentioned in the previous paragraph, in the event of a failure on their part to comply with the provisions of this article.
