Article L1418-6 of the French Public Health Code

The Agency’s staff are governed by the provisions of articles L. 5323-1 to L. 5323-4.

The members of the Agency’s Board of Directors and any other persons in possession of information held by the Agency are bound by professional secrecy under the conditions and subject to the penalties laid down in articles 226-13 and 226-14 of the French Penal Code.

In addition, members of the Steering Committee, groups of experts or any other committee sitting within the Agency may not, subject to the penalties laid down inarticle 432-12 of the Criminal Code, take part in the deliberations or votes of these bodies if they have a direct or indirect interest in the matter being examined. This declaration is updated on their own initiative as soon as there is a change in these links or new links are established. It is made public. The operating rules of these bodies guaranteeing the independence of their members and the absence of conflicts of interest shall be laid down by regulation.

The Ministers for Health and Research and the Director General of the Agency may respectively terminate the functions of the members of the Advisory Board mentioned in 2° to 4° of Article L. 1418-4 and the members of the groups and commissions mentioned in the previous paragraph, in the event of a failure on their part to comply with the provisions of this article.

Article L1418-6

Les personnels de l’agence sont régis par les dispositions des articles L. 5323-1 à L. 5323-4.

Les membres du conseil d’administration de l’agence ainsi que les personnes ayant à connaître des informations détenues par celle-ci sont tenus au secret professionnel dans les conditions et sous les peines prévues aux articles 226-13 et 226-14 du code pénal.

En outre, les membres du conseil d’orientation, des groupes d’experts ou de toute autre commission siégeant auprès de l’agence ne peuvent, sous réserve des peines prévues à l’article 432-12 du code pénal, prendre part ni aux délibérations ni aux votes de ces instances s’ils ont un intérêt direct ou indirect à l’affaire examinée. Cette déclaration est actualisée à leur initiative dès qu’une modification intervient concernant ces liens ou que de nouveaux liens sont noués. Elle est rendue publique. Les règles de fonctionnement de ces instances garantissant l’indépendance de leurs membres et l’absence de conflits d’intérêts sont fixées par voie réglementaire.

Les ministres chargés de la santé et de la recherche et le directeur général de l’agence peuvent mettre fin aux fonctions respectivement des membres du conseil d’orientation mentionnés aux 2° à 4° de l’article L. 1418-4 et des membres des groupes et des commissions mentionnés à l’alinéa précédent, en cas de manquement de leur part aux dispositions du présent article.
