Article L1418-8 of the French Public Health Code

The procedures for applying the provisions of this chapter shall be determined by decree in the Conseil d’Etat, which shall in particular lay down :

1° The administrative, budgetary, financial and accounting system of the Agency and the State control to which it is subject;

2° The rules applicable to the Agency’s contract staff;

3° The private activities which, by reason of their nature, contract staff of the agency who have ceased their duties may not engage in; this prohibition may be limited in time;

4° The procedures for setting and revising the overall allocation provided for in 2° of article L. 1418-7;

5° The conditions under which one or more of the agency’s support and back-up services may be pooled with one or more services of other bodies in application of article L. 1411-5-3.

Article L1418-8

Les modalités d’application des dispositions du présent chapitre sont déterminées par décret en Conseil d’Etat ; celui-ci fixe notamment :

1° Le régime administratif, budgétaire, financier et comptable de l’agence et le contrôle de l’Etat auquel celle-ci est soumise ;

2° Les règles applicables aux agents contractuels de l’agence ;

3° Les activités privées qu’en raison de leur nature les agents contractuels de l’agence ayant cessé leurs fonctions ne peuvent exercer ; cette interdiction peut être limitée dans le temps ;

4° Les modalités de fixation et de révision de la dotation globale prévue au 2° de l’article L. 1418-7 ;

5° Les modalités selon lesquelles un ou plusieurs services d’appui et de soutien de l’agence peuvent être mutualisés avec un ou plusieurs services d’autres organismes en application de l’article L. 1411-5-3.
